Involuntary Manslaughter – Sentenced as a Juvenile, Not an Adult

Fogt Law represented a juvenile who followed a group of friends as they attempted to commit an armed burglary, which resulted in the tragic death of one of the perpetrators. Due to his participation, the juvenile was adjudicated for Involuntary Manslaughter, a first-degree felony with a firearm specification and Burglary (person present), a second-degree felony. Prosecutors attempted to try our client as an adult, rather than as a juvenile. And then still attempted to have the juvenile sentenced as an adult. If convicted as an adult, our client could have faced the possibility of over twenty years in adult prison. An Amenability Hearing was held to determine whether our client could be rehabilitated, wherein Attorney Fogt successfully cross-examined a psychiatrist on the stand that argued to have our client sentenced as adult.
After Attorney Fogt argued passionately that an adult sentence was too harsh and a juvenile sentence was more appropriate, the Court agreed and ruled in favor of the Defense. Our client was adjudicated in the juvenile justice system, rather than tried as an adult. He was ordered to serve a total of two years at Dayton Youth Services, along with other juveniles his age.
Our client has a bright future ahead of him.
