OVI Reduced to Non-Moving Violation, Traffic Light Citation Dismissed
Client was pulled over by police and charged with his second OVI in 20 years after refusing to consent to a breathalyzer test. He was also cited for running a traffic light. After Attorney Fogt discussed the case with the prosecutor, the OVI was reduced to Physical Control of a Vehicle While Under the Influence, which is a non-moving violation and the failure to stop at a traffic light charge was dropped. If Client had been convicted of the OVI, he could have been sentenced to up to 180 days in jail and been fined up to $1,075. Instead, he just received a one-year license suspension with driving privileges and a fine of only $400.
